VIP WebStore Terms and Conditions

Sales Policy

The prices displayed on the VIP WebStore (the "Site") are quoted in Australian (AU) Dollars. However, it should be noted that prices for services and/or product packages to be facilitated within Australia are quoted in AU Dollars and only valid for delivery within Australian Major Cities/Regions. As such the price for services and/or product packages required to be facilitated outside of Australia may be adjusted as EU within European or US Dollars elsewhere, and exclude VIP Facilitator/s Travel and Accommodation Expenses, for your booking to be confirmed as valid and effective outside of Australia.

Prices quoted as exclusive of shipping or gst/sales taxes. All product only purchases are shipped on a 'user pays' basis which will be added to your total invoice price or invoiced separately if necessary prior to shipping. The customer is to select the class of service and will be charged as indicated on the Site, otherwise goods will be shipped via the most cost-effective express service as deemed relevant to the cost of the goods being shipped.

While we will use our best efforts to fulfill all orders, VIP cannot guarantee the availability of any particular product and/or program displayed on this Site. VIP reserves the right to discontinue the sale of any product listed on this Site at any time without notice.

While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information, availability and product specifications. VIP reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted). If we discover price errors, your order will suspended and you will be contacted, given the corrected price information and given the opportunity to confirm or cancel your order.

Products and services offered through the Site may pertain to product and services owned and offered exclusively by VIP Sponsors and Strategic Partners. VIP reserves the right to refuse or cancel any orders placed for such products and/or services by parties we deem may not have official authorisation by your organisation for such purchases and/or where such products/services are not currently or no longer available.

To serve all customers properly, VIP reserves the right to limit order quantities and to cancel multiple orders of the same item purchased by the same Site user and/or shipped to the same delivery address.

All orders are subject to a minimum order size of $50, exclusive of shipping and taxes. All initial orders are subject to a maximum dollar value per order of $15,000, exclusive of shipping and taxes.

All of our products, unless specifically stated otherwise, are new.

Payment on the Site is exclusively by credit card. VIP accepts Visa and MasterCard via PayPal only.

For EFT payments or customised service/product packages, please contact VIP via 'Contact Us/Feedback Form'. If VIP agrees to fulfill such request, customer will be issued a Tax Invoice for immediate EFT payment prior to the selected service/products package being confirmed as booked and/or shipped.

Back Order Policy

Every effort is made to ship customer orders complete. Complete orders will be shipped at once. Incomplete orders will be held for a short time so that VIP can ship all items atone time. Most merchandise is in stock for immediate shipment and orders are processed within 24 hours.

If VIP should be temporarily out of stock on an item, customers may be offered the choice on the Site to back-order the item or eliminate the item from the order. If no choice is made, the default is to back-order the item. VIP will back-order that item and ship the remainder of customer order immediately. Customers must specify if they would prefer to delay shipment until the entire order is complete. If there are extended delays in back-ordered items, VIP will email the customer with the details.

Return Policy

Risk of loss pass to the customer upon purchase and tender of the shipment to the carrier. If the product is damaged in transit, the customer must file claim with the carrier. VIP will not accept returns for shipping damage.

If a product arrives defective or becomes defective during its warranty period the customer must notify VIP within 10 days of receipt, VIP will arrange with the customer to exchange or receive a refund for the product, including return shipping charges negotiated and paid by VIP. For warranty information and claims, refer to the Product Warranty below.

Orders that result in a return for any other reason, eg wrong item ordered, refusal, etc, may incur return shipping charges and a restocking charge of 10%. Such returns must be in new condition with original packaging. Returns not meeting this standard will be assessed additional restocking charges determined at the sole discretion of VIP.

Before returning any product, customer must contact VIP Webstore Customer Service via Contact Us/Feedback Form. Returns may be handled through VIPs Return Material Authorisation ("RMA") procedure, wherein VIP will issue the customer an RMA number, which must accompany the return shipment.

Product Warranty

The relevant product/service supplier warrants and implies that the items delivered under this agreement are merchantable and fit for the use for the particular purpose described in this agreement.

ALL CONTENT ON THIS SITE IS PROVIDED "AS IS"; ALL USE OF THIS SITE IS AT YOUR OWN RISK. VIP DISCLAIMS, AND YOU HEREBY WAIVE, ANY AND ALL WARRANTIES AND LIABILITIES OF VIP, WHETHER EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, WITH RESPECT TO THIS SITE AND ANY CONTENT ON THIS SITE, INCLUDING, BUT NOT LIMITED TO, ANY (A) IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (B) IMPLIED WARRANTY OF NON-INFRINGEMENT; AND (C) CLAIM IN TORT (INCLUDING NEGLIGENCE). Security and Privacy

The Site is hosted, operated and maintained by VIP. However, VIP cannot guarantee that any electronic commerce on its Site is invulnerable to attack and totally secure.

VIP does not release any personal or other customer information given to it when ordering, to any telemarketing company, reporting service, or any third party other than VIP's credit card processor for the purpose of authorizing credit card transactions requested by the customer.

This Site may contain links to other sites that are neither owned nor operated by VIP (collectively, "ThirdParty Sites"). Such links are provided for your convenience only. VIP makes no representations whatsoever about any Third Party Sites, which you may access through this Site, as VIP, has no control over the content appearing on such Third Party Sites. Moreover, a link to a Third Party Site does not imply and does not constitute sponsorship, endorsement, approval or responsibility for the contenton, or the use of, such Third Party Site. The privacy policies applicable to Third party Sites may differ significantly from VIP's. You are encouraged to review the applicable privacy policies of such Third Party Sites.

Policy Updates

Any updates in the Terms and Conditions of Sale, Terms of Access to the Site, Security and Privacy Policies will be decided and published by VIP. Please check the Site periodically for updates. Notice of any material changes in the way VIP handles personally identifiable information under this policy will be provided on the Site.

Jurisdiction

By accessing and using this Site, you agree that your access and use of this Site are subject to these Terms and Conditions, as governed by the laws of the Federal Court.

Trademarks

The trademarks, service marks and logos (the "Trademarks") used and displayed on this Site are registered and unregistered Trademarks of VIP and others. Nothing on this Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Site, without the prior written permission of the Trademark owner. VIP aggressively enforces its intellectual property rights to the fullest extent of the law. The VIP logo may not be used in any way, including in advertising or publicity pertaining to distribution of materials on this Site, without prior, written permission from VIP. VIP prohibits use of the VIP logo as part of a link to or from any site unless establishment of such a link is approved in advance by VIP in writing. Fair use of VIP's Trademarks requires proper acknowledgment. Other product and company names mentioned in this Site may be the Trademarks of their respective owners.

Customer acknowledges that all Product, Service and Technical Documentation displayed, linked or listed for sale, directly or indirectly via VIP, VIP WebStore, or VIP Sponsors and Strategic Partners, contain VIP copyright protection and is for reference only and may not be redistributed in any form or manner without written authorisation by VIP.

Contract Displute

All purchases made by customer under this agreement are subject to the Contract Disputes Act as upheld by the Australian and/or Queensland Court of Law.
